These Terms and Conditions ("Terms") govern access to and use of vandemataram.foundation and the online donation, sponsorship, campaign, and payment pages operated by or linked on behalf of Vandemataram Foundation (the "Platforms"). By using a Platform or submitting a donation, you agree to these Terms and the policies referenced in them.
1. About VMF and the Donation Channels
VMF supports charitable and social-impact initiatives, including rural education, child and student support, meal sponsorships, study centres, and related community programs described on the Platforms. A donation may be received by the VMF entity identified on the relevant checkout page, payment page, acknowledgement, or receipt.
2. Eligibility and Authority
You must be legally capable of entering into a transaction and authorised to use the selected payment method. If you donate on behalf of another person or organisation, you confirm that you have authority to do so and that the information you provide is accurate.
3. Nature of Donations
Donations are voluntary charitable contributions and are not purchases of goods, investments, deposits, or loans. No donor acquires ownership, governance, beneficiary-selection, repayment, or commercial return by making a donation. Benefits such as acknowledgements, program updates, or tax receipts are incidental to the charitable contribution.
4. Donation Information
You agree to provide complete and accurate donor, contact, tax, and payment-related information. VMF may decline, hold, reverse, or return a donation where required by law, a payment provider, risk controls, sanctions requirements, suspected fraud, or an inability to lawfully accept the funds.
5. Payment Processing
Payments may be processed through third-party providers such as Razorpay, PayPal, banks, UPI systems, or card networks. VMF is not responsible for a bank decline, authentication failure, network outage, payment-provider interruption, foreign-exchange conversion, or bank charge outside VMF's control. Do not initiate a second payment until you have checked the status of a pending transaction.
6. Receipts and Tax Treatment
VMF may issue a donation acknowledgement, receipt, or tax-related document based on the information supplied. Eligibility for deduction under Section 80G of the Income-tax Act, 1961, U.S. Internal Revenue Code section 501(c)(3), or another tax regime applies only where the donation, recipient entity, donor, receipt, and applicable law satisfy the relevant requirements. Donors are responsible for obtaining independent tax advice. VMF does not guarantee a particular tax result.
7. Use and Allocation of Donations
VMF will make reasonable efforts to apply a designated donation to the program selected by the donor. Where the selected purpose cannot reasonably be fulfilled or has been fully funded, VMF may contact the donor or apply the funds to a closely related charitable purpose consistent with VMF's mission.
8. Scheduled and Dedicated Donations
For a program involving a requested meal date, occasion, dedication, photograph, or message, the requested date or presentation is subject to availability and operational feasibility. VMF may edit, decline, or omit content that is unlawful, misleading, unsafe, discriminatory, or inconsistent with the dignity and welfare of beneficiaries.
9. Donor-Submitted Content
You retain ownership of content you submit. You grant VMF a limited, non-exclusive, royalty-free right to use, reproduce, adapt, and share the content only as reasonably necessary to administer the requested donation or program.
10. Refunds and Cancellations
Donations are ordinarily final once successfully processed. Limited exceptions are stated in VMF's Refund Policy and Cancellation Policy, which form part of these Terms.
11. Website Content and Intellectual Property
Unless otherwise stated, the Platforms and their text, design, logos, graphics, photographs, videos, and reports are owned by VMF or used with permission. You may not copy, scrape, republish, commercially exploit, or distribute substantial Platform content without permission.
12. Acceptable Use
You must not use a Platform to:
- Engage in fraud, impersonation, money laundering, or any illegal activity.
- Upload malicious code, interfere with Platform security, or disrupt availability.
- Collect personal data about others without authority, or scrape the Platforms.
- Submit false, defamatory, hateful, exploitative, infringing, or privacy-invasive content.
- Misrepresent a relationship with VMF, its beneficiaries, employees, volunteers, or partners.
13. Third-Party Services and Links
Third-party payment, social-media, mapping, video, or partner services may be linked or embedded. They are governed by their own terms. VMF is not responsible for third-party services outside its control.
14. Disclaimer
VMF seeks to keep Platform information accurate and current but does not warrant that every item will be complete, error-free, uninterrupted, or continuously available. The Platforms are provided on an "as available" basis to the extent permitted by law.
15. Limitation of Liability
To the maximum extent permitted by applicable law, VMF and its trustees, directors, officers, employees, volunteers, affiliates, and service providers will not be liable for indirect, incidental, special, punitive, or consequential loss arising from use of the Platforms or a third-party payment service.
16. Indemnity
You agree to be responsible for loss, claims, or reasonable costs arising from your unlawful use of the Platforms, your material breach of these Terms, your unauthorised use of another person's payment method, or content you submit without the necessary rights or consent.
17. Suspension or Refusal
VMF may restrict access, reject content, suspend a transaction, or refuse a donation where reasonably necessary for security, legal compliance, beneficiary protection, or fraud prevention.
18. Governing Law and Disputes
For donations received by VMF's India channel, these Terms are governed by the laws of India, and disputes will be subject to the jurisdiction of competent courts in Telangana, India, unless mandatory law requires otherwise.
19. Changes to these Terms
VMF may revise these Terms from time to time. Changes apply from the updated effective date. A donation is governed by the version available when the donation was submitted.
